1. Agreement to Terms
By submitting a form, requesting a demo, participating in a setup or pilot, using the RoofPulse System™, or becoming a paying client, you agree to these Terms of Service (“Terms”).
“GETROOFPULSE,” “we,” “us,” and “our” refer to the business operated by Hayden Keithley in Collierville, Tennessee. “RoofPulse System™” refers to the missed-call recovery and follow-up system provided by GETROOFPULSE. “Client,” “you,” and “your” refer to the business or person using or purchasing our services.
If you do not agree with these Terms, do not use GETROOFPULSE services or the RoofPulse System™.
2. Services Provided
GETROOFPULSE provides the RoofPulse System™, a missed-call recovery, after-hours lead response, storm-call response, and follow-up system for roofing and related home service businesses.
Depending on the arrangement, services may include:
- Missed-call text-back automation
- After-hours or storm-call follow-up sequences
- Lead capture and basic qualification workflows
- Appointment booking assistance or handoff
- Simple pipeline tracking and lead status organization
- Old lead reactivation campaigns, if separately approved
- Review request automations, if included in your plan
- Basic reporting on captured leads, replies, and booked opportunities
The exact services included are determined by your written or verbal agreement, proposal, invoice, onboarding form, or other agreed setup details.
3. Free Setup / Performance Pilot
GETROOFPULSE may offer free setup or a limited performance-based pilot to qualifying businesses. Unless otherwise agreed in writing, the pilot is meant to prove whether the RoofPulse System™ can help capture missed-call opportunities before a paid subscription begins.
- No automatic charge: You will not be automatically charged unless a paid plan is agreed to.
- Setup access: You agree to provide the access and information needed to configure the system, such as business number, hours, service area, and approved message scripts.
- Payment trigger: If the system books or helps create a qualified job opportunity, you may be asked to continue on a paid monthly or performance-based plan, depending on the agreed offer.
- Limited availability: Free setup or pilot offers may be limited and can be accepted, paused, or declined by GETROOFPULSE at our discretion.
- One pilot per business: Unless approved by us, a business may only receive one free pilot or setup offer.
4. Payment and Billing
- Pricing: Pricing may be monthly, performance-based, setup-based, or a combination, depending on the agreement.
- Monthly plans: If you choose a monthly plan, billing occurs monthly unless otherwise agreed.
- Performance fees: If a pay-per-booked-job or performance arrangement is used, the definition of a qualified booked job should be agreed before launch.
- Late payment: If payment is overdue, we may pause or limit services until payment is received.
- Price changes: We will provide reasonable notice before changing pricing for active clients.
- No partial-month refunds: Unless otherwise agreed, payments are not prorated for partial months.
5. Cancellation
GETROOFPULSE is intended to be simple and low-friction. Unless a separate written agreement says otherwise:
- You may cancel at any time by contacting us directly.
- Please provide at least 7 days’ notice before your next billing date to avoid being charged for the next month.
- Upon cancellation, automations may be disabled at the end of the current billing period or sooner if requested.
- Upon request, we will make reasonable efforts to export or provide your lead data within 5 business days.
- Cancellation does not remove your responsibility to pay amounts already owed.
6. SMS, Calls, and Compliance
The RoofPulse System™ may help your business respond to customers or potential customers by SMS, phone, email, or other communication methods. These communications may be subject to laws and carrier rules, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA guidelines, state privacy laws, and other applicable rules.
You are responsible for ensuring that your business has the right to contact the leads, customers, or prospects being messaged through the RoofPulse System™.
- Inbound inquiries: Missed-call text-backs are intended to respond to people who contacted your business first.
- Approved scripts: You must review and approve message scripts before they go live.
- Opt-outs: If a recipient asks to stop, unsubscribe, opt out, or not be contacted again, you must honor that request. GETROOFPULSE may also help manage opt-outs where supported.
- No spam: You may not use the RoofPulse System™ to send unsolicited bulk messages or unrelated promotions.
- Customer consent: If you provide lists for reactivation or follow-up, you are responsible for ensuring those contacts were collected and may be contacted legally.
7. Client Responsibilities
To use the RoofPulse System™ effectively and responsibly, you agree to:
- Provide accurate business information, including phone number, service area, hours, and contact details.
- Review and approve all scripts, offers, booking language, and follow-up messages before launch.
- Respond to live leads, booked appointments, urgent requests, and escalations in a reasonable time.
- Notify us promptly if your phone number, team availability, service area, pricing, or offer changes.
- Use the RoofPulse System™ only for lawful business purposes.
- Not use GETROOFPULSE services to mislead customers, impersonate another business, or send prohibited communications.
8. Our Responsibilities
GETROOFPULSE will make reasonable efforts to:
- Set up agreed workflows promptly after receiving required information.
- Use approved scripts and business information when configuring automations.
- Monitor basic functionality during onboarding or active service periods.
- Notify you if we become aware of major issues affecting your system.
- Respect the confidentiality of your business and customer data.
- Provide reasonable support for issues related to RoofPulse System™ workflows.
We are not responsible for services, delays, outages, or errors caused by third-party platforms, phone carriers, internet providers, or tools outside our direct control.
9. Data and Ownership
- Your business data remains yours. Leads, customer information, appointment details, and conversations generated for your business belong to your business.
- Service access: You grant GETROOFPULSE permission to access and process necessary data only to provide and improve the service.
- No selling customer data: We do not sell your customer or lead data.
- Aggregated analytics: We may use anonymized or aggregated performance data to improve the RoofPulse System™ and describe general performance trends, as long as it does not identify your business or customers.
- Workflow ownership: Templates, scripts, workflows, configurations, strategy, and systems created by GETROOFPULSE remain GETROOFPULSE property unless otherwise agreed. You receive permission to use them while you are an active client.
10. Third-Party Platforms
GETROOFPULSE may use third-party tools and platforms to provide service, such as CRM systems, SMS providers, phone providers, form tools, analytics tools, payment processors, or automation software.
These platforms may have their own terms, policies, limitations, outages, fees, registration requirements, carrier rules, and compliance requirements. GETROOFPULSE is not responsible for third-party downtime, rejected messages, carrier filtering, account restrictions, or platform changes outside our control.
11. Prohibited Uses
You may not use GETROOFPULSE services or the RoofPulse System™ to:
- Send spam, unsolicited bulk messages, or unlawful marketing communications.
- Contact people who have opted out or asked not to be contacted.
- Violate any federal, state, or local law or regulation.
- Harass, threaten, deceive, or abuse any person.
- Impersonate another business or misrepresent your services.
- Transmit harmful code, malware, or abusive content.
- Resell, sublicense, copy, or reverse engineer GETROOFPULSE systems without permission.
Violation of these Terms may result in suspension or termination of service.
12. Results and No Guarantee
The RoofPulse System™ is designed to improve missed-call response, lead follow-up, and booking opportunities. However, we do not guarantee specific revenue, appointment volume, close rates, job value, or business results.
Results depend on many factors outside our control, including your market, call volume, reputation, availability, pricing, response time, sales process, weather events, service quality, competition, and customer demand.
13. Limitation of Liability
To the maximum extent permitted by law, GETROOFPULSE and its operator will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost customers, lost opportunities, data loss, or business interruption.
To the maximum extent permitted by law, GETROOFPULSE’s total liability for any claim related to the service is limited to the amount you paid to GETROOFPULSE in the three months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.
14. Disclaimer of Warranties
GETROOFPULSE services and the RoofPulse System™ are provided “as is” and “as available.” We make reasonable efforts to provide reliable service, but we do not warrant that the service will be uninterrupted, error-free, fully secure, or available at all times.
We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute related to these Terms or GETROOFPULSE services will be handled in the state or federal courts located in or serving Shelby County, Tennessee, unless applicable law requires otherwise.
Before taking formal legal action, both parties agree to make a reasonable, good-faith effort to resolve the issue directly.
16. Changes to Terms
We may update these Terms from time to time. If changes are material and you are an active client, we will make reasonable efforts to notify you. Continued use of GETROOFPULSE services or the RoofPulse System™ after updated Terms are posted or provided means you accept the updated Terms.
